Fiction:

Schools can insist children wearing masks or face covering in the name of Covid.

Law:

Health and safety law did not change with the arrival of Covid (SARS-Cov-2). We are providing free to parents to download for personal use (though we have a donate button) draft letter to use to send to your child’s school and your local authority. It asserts the right of yours and all children at the school not to wear any mask and demands immediate action from the school.

Get a cup of tea. The letter sets out all you, the school and its lawyers need to know about the law and school policies regarding masks. Share it with everyone you know.

The letter is drafted for local authority schools in England but the substance of it will apply equally in other parts of the United Kingdom and to private schools and academies.

The letter is also a formal and detailed ‘letter before action’ of the sort solicitors would send before start Court proceedings. Using the letter does not oblige you to take any further action.  However, if schools and authorities do not respond as demanded, it may allow proceeding to be started quickly. This is important since mask policies are being introduced quickly.

  2. I strongly disagree with compulsory testing and the wearing of face masks on children in schools haven’t our children suffered enough this situation over this fake pandemic is getting out of control and I am considering removing my child from school and bugger the consequences.

  3. This is great but I am a teacher and have been forced to wear a mask. Can anything be done so that I don’t have to wear the mask?

      The government website says you can get an exempt lanyard and it states that if you geel you can not breath or feel panicked then you can be exempt!

    2. You are exempt – gov website – if it “causes extreme distress” and for those in your care to “hear clearly.” Your school has no legal right to enquire what your exemption is or to require you to wear any lanyard. You just need to know this information and then apply it with calm confidence. There is nothing at all they can do.

  4. Thank you for this. However, there is a lot of information and action around the mask issue but what of the testing? My concern is that the schools are not making it clear to parents or, most importantly, to the children that this is voluntary and that there will be no repercussions for refusing to participate. They’re dealing with teenagers who want to fit in and not be seen as the weird kid or odd one out. The children are being coerced and played without fully understanding the consequences of their participation.

    1. Yes, but the key is guidelines. I believe the actual word used in the government’s guidelines to schools is “recommend”.

  6. I hate how they have to test you every time you go to school the cases are dying down so I don’t see the point of wearing or testing kids in school anymore.

    The blatant abuses, bullying and shaming are unacceptable. My own research has concluded the total exaggeration of the overall statistics and the negative impact of the lockdowns, fears, false media information. We need the lawyers to step up and protect our rights.

  9. Hi there. I do not have a child in school. My son has always been home educated. However I really want to help other parents with this issue. Can I fill this out as a concerned member of society? And still send it to various schools? I’d really appreciate your advice. Kind regards

  10. This letter is excellent, for parents and children to assert their rights. It would be wonderful if you could draft a similar letter for teachers who feel they will suffer detriment to their well-being and be at risk of illness from being exposed to potential carriers of Sars-cov-2.

    1. yeah, you’re an idiot, sorry but you really need to get with the science and the real world. Masks are utterly useless vs viruses, can you prove otherwise ? Quit with the irrational fear, the vaccine is now here so have it and shutt up, you’re protected thereafter right ? no ? still need to wear the mask ? don’t bring others into your psychosis especially children !

  12. I received this reply from my child’s Headteacher in response to the letter above….

    “I can confirm receipt of your letter via email to my personal account yesterday evening.

    Following consultation with legal and public health colleagues the school’s position is that we will follow all government guidance in our contribution to protecting the health and wellbeing of individuals and the public. Our priority is to keep the school open and running as close to normally as we can without the need for full or partial closures caused by either outbreaks of COVID 19 or large-scale need for staff isolation as a result of possible contact or failure to adhere to social distancing and other non-clinical protective measures. We managed this very successfully in the autumn term and education was uninterrupted by any such need to close during the whole of that period.

    As you will be aware we require and have requested parental consent for the testing of secondary pupils which is to occur on 3 occasions in school prior to the Easter break (thereafter this is proposed to be done in the home). If no consent is received then testing will not occur and no pupil will be denied an education as a result of this.

    No child will be forced to wear a face covering or refused education because they are not wearing one. The use of face coverings by secondary age students indoors where social distancing cannot be maintained is recommended by government but not required by law. The vast majority of our pupils aged 11 or above chose to wear a face covering last term.

    As it is clearly infeasible to enter into detailed correspondence with every parent individually on this matter we will be sending out a definitive letter later this week with all recommendations and guidance. “

    I have already refused consent to test and I wonder if a re-request is a way to avoid past refusals. I shall re-iterate my refusal to consent to testing and make clear it is the default.

    I hope this helps and I think even if yo are not a parent then it is worth sending ot the LA so they cannot claim plausible deniability later.

  13. First day back to school for my son today. I have had 3 phone calls regarding him wearing a face covering and its not even midday!
    I have not consented to testing and he is ‘exempt’ from wearing a face mask. The school have given him a face shield to wear, and told him he must wear that or a mask, or go home and continue on-line learning.
    The Headmaster said that because he has not been tested and isn’t wearing a face covering that he provides a great risk to the whole school community and therefore can’t attend the site without doing one or the other.
    This is an independent school and he is in the first year of sixth form. Does anyone know where we stand on this? My son wants to be at school, he wants to learn and do well in his exams and be with his mates. We are being coerced. Any suggestions would be greatly appreciated.

  14. My daughter sent your letter, thanks very much for it, and then sent the one from Lawyers for Liberty for good measure.
    Her son’s school has responded by insisting that kids will wear masks all day, unless they have a ‘medical exemption.’
    Those that won’t comply will still be given an education but in an alternative space and online rather than with their class mates and teacher.
    Technically they are fulfilling the requirement to provide an education?
    I looked at the crowd fund page but I’m not clear whether you are intending to challenge this apartheid. I would like to contribute if that’s the case. Could you clarify the situation.

  15. Can this letter be used to send to my 17 year old Sons College? Or are things different with regards to college? I’m struggling to find any confirmation of this being the case. He won’t be 18 until August.

  18. covid has never been isolated.. 40 countries FOI including Wuhan China say this. Writ of Habeous Corpus in Lisbon last november succeeded as no evidence of any isolate produced.. the germ theory is a hundred year old theory that science has proven to be false. As there is just going to be false ebola swine flu pandemics ..again never isolated… there really needs to be a court case to prove this is all fake and sham and the pcr tests which I know German lawyers have also said is proven to be fake and false ..law suits pending… otherwise this is going to be a regular occurrence. German lawyers say nuremburg trials will happen …but when .. children are being damaged now…

    I am at my wits end. Sorry for the long email.
    I run an after school club.
    The head teacher wrote to me before we went back on the 8th March saying parents had complained about my fb page and accused me of being a covid denier. He also said myself and my staff must wear a face mask at all times. He threatened to close the club if I did not comply.
    I responded, saying amongst other things that no one had asked us to wear masks. I also told him I had an exemption.
    No one was wearing masks when we went back on the 8th – so we didn’t.
    On the 12th March I received another email, this time saying your staff have not been wearing masks in communal areas – another threat to close the club.
    The next week(15th) everyone is wearing masks, except some teachers.
    My staff complied, I didn’t wear a mask.
    By the way I contacted my doctor and was told they don’t provide letters for exempt people because you don’t have to provide evidence! I told the head teacher that.
    This week, I get two more email- one a teacher has complained that one of my staff is in the communal area with no mask. I think it can’t be me I have an exemption.
    The last email (today) says: We realised that neither of us has actually seen your medical exemption! Please could you either show it at the hatch next time you sign in or you could photograph/scan it over in an email? Whatever is more convenient!

    We had a long discussion about staff wellbeing because I’ve had a couple of reports of you being in the communal areas without a mask and it’s causing some unnecessary stress and anxiety with my staff… And we think we’ve come up with a great solution! When you’re in, please stop at the office as normal to sign in and get a sticker, then my team will let you out through the gate into the playground (they have a release button in the office). From there you can just walk across the playground to the door that’s right by the Year 4 base where your colleagues can let you in. (That way you’re only walking a couple steps in the communal areas!) Then at the end of your session it’s quite late so please feel free just to leave through the front door as staff will be negligible at that point.
    Q: Is my exemption card enough – can they demand a GP letter.
    Q: is it right that they should not allow an exempt person into the school?
